  1. General information
  1. This document describes the rules and terms of use of the LocoMe Internet service and its mobile version. The document contains the rights, obligations and responsibilities of the registered LocoMe users and system administrator. The following terms of use have been set based on the legal regulations of the Republic of Poland.
  2. Registration in the LocoMe is tantamount to accepting all rules set hereby. It is advised that any potential user should read the following terms before registration.
  3. LocoMe is a communication platform allowing sharing, transmitting and receiving various kinds of information between the users at a given place and time, using Internet access and localisation technologies.
  4. Using LocoMe service requires having a device capable of connecting to the Internet and equipped with a Web browser.
  5. The whole of the LocoMe service is legally protected by copyright laws. LocoMe consists of the following elements: the idea, application (software), content, graphic design, logo and database. Any copying, public presentation, sharing, and selling of any of the aforementioned elements requires LocoZone Sp. z o.o.’s agreement.
  6. LocoMe is owned by LocoZone Sp. z o.o, located at 56 Legnicka Street, 54-204 Wrocław, Poland, registered in the Companies Register in the Wrocław-Fabryczna Local Court, VI Business Department under KRS No. 0000311356, NIP: 894-29-48-826, REGON: 020773695, initial capital: 1 443 500 PLN.
  1. Changes to the rules and terms of use
  1. As the administrator, LocoZone Sp. z o.o., reserves the right to alter the rules and terms of use without the need to substantiate. All changes will be published at www.locome.pl.
  2. In the event of aforementioned changes, the further use of the service by the user will be considered as acceptance of those changes. After logging in, the user will be informed about the changes and where to find the details.
  1. Personal data and policy privacy information

 

  1. Registration in the service means user’s compliance with publishing and processing his/her personal information in accordance with the Privacy Policy. This document is available on the LocoMe website.
  2. While registering, the user is obliged to provide authentic and up to date information (especially e-mail address) in order to verify the contact. The user is obliged to update his/her personal information.
  3. Every LocoMe user individually decides about his/her privacy settings and the information that will be visible to other LocoMe users.
  4. Every user has the right to modify or delete his/her personal data, in accordance with the rules set in the Privacy Policy and the personal data protection act of 29th August, 1997.
  1. Participation and rules of using the service
  1. The LocoMe user can be any adult person having full legal capability. Underage or not fully legally capable person needs to gain a permission of its legal representative before using the LocoMe service.
  2. Participation in the service requires registration which is tantamount to entering into electronic service agreement for an unspecified period of time. The agreement is made between the administrator and the user and can be terminated immediately by any party, based on the rules set in clause V.
  3. The effect of the LocoMe registration procedure is setting up a user account. One user can have only one user account. It is forbidden to allow access to the user account to any third party, as well as using other user’s account.
  4. The registration and using the LocoMe service is voluntary and is not connected with any charges or payments for LocoZone Sp. z o.o. The user shall cover the costs of internet access and data transmission, as set in the price list set by his/her ISP or mobile network.
  5. LocoZone Sp. z o.o. reserves the right to introduce charges for any services operated within the LocoMe service. The administrator is obliges itself to inform the users in advance. The user has the right to not accept chargeable services.
  6. By registering in the LocoMe service, the user declares, what follows:

a) That he/she has read the hereby terms of use and has accepted all its provisions;

b) That he/she will use LocoMe and its services on his/her own free will;

c) That he/she has given authentic and up to date data during the registration procedure;

d) That he/she agrees for his/her personal data and image to be processed in accordance with the rules described in the Privacy Policy and rules set hereby. He/she also agrees for his/her data to be visible in accordance with the privacy settings in his/her profile;

e) That any and all personal data, images and information regarding other persons are put on his/her profile lawfully and with other person’s consent;

f) That he/she agrees to receive on his/her e-mail address, given during the registration procedure, administrative information (system messages, technical breaks notifications, changes in the terms of use, new LocoMe functions, messages received, invitations and so on) and commercial information (if he/she has chosen appropriate settings in his/her privacy settings).

  1. By using the LocoMe service, the user obliges himself/herself to follow the following rules:

a) Any and all action which may destabilize the service or make its use harder are forbidden and can be considered a legally unlawful action;

b) It is forbidden to break copyright law as well as breaking invention, patent, trade mark, utility and industrial design rights of other persons or administrator;

c) Any action violating other users’ privacy and personal rights, especially gathering, processing and forwarding information regarding other users without their explicit consent is forbidden. The above excludes the situation when it is allowed by law and the terms of use set hereby;

d) It is forbidden to use the service in a way contrary to its goals, especially to publish content breaking the Polish law, abusive, untrue and immoral; to promote pornography, violence, hatred, any form of discrimination; to violate public order, personal good name or dignity; even if there is only an assumption of such actions;

e) It is forbidden to use the private message function to send unwanted business messages and other unsolicited content (spam).

The breach of any of the aforementioned terms by user may result in blocking or removing his/her account by the administrator, as per clause V.

  1. Publishing personal information, image or any other content in the LocoMe service by a user, means user’s consent for that information to be viewed by other viewers and administrator. The user-published content regarded by law as a work of art (as per copyright law of 4th February, 1994, Dz. U. 2006 r., nr 90, pos. 631 with changes) means that the user surrenders his/her claims towards LocoZone Sp. z o.o. which may stem from the use of this content (including copying and removing it from the service).
  2. Every user has the right block the option of receiving private messages from other user, excluding the administrator.
  3. LocoZone Sp. z o.o. reserves the right to modify the LocoMe service, its functions, services provided and the way of working. The Company has also the right to remove any data gathered in the system database, to cease operations or to transfer the rights to other entity. No claims can be directed towards LocoZone Sp.z o.o. because of the above.
  1. Deleting and blocking user account
  1. 1. The administrator reserves the right to block an account belonging to a user, who:

a) Is acting in a way harmful to the service or its users;

b) Is breaking any regulation set herein;

c) Is publishing content and/or images which may have a negative influence on LocoMe’s image – especially those of a type set in point 7d, clause IV;

d) Is sending unsolicited commercial or promotional messages (spam) to other users in a form of private messages;

e) Has committed a crime as regulated by law.

  1. The administrator is authorized to remove images and content described in point 7d, clause IV from the service.
  2. Both the administrator and the user have the right to terminate the electronic service agreement immediately and without stating a reason
  3. The user terminates the agreement by deleting his/her account. In order to do that, he/she should contact the administrator (see: Contact).
  4. The administrator terminates the agreement by deleting or blocking user account.
  1. Accountability
  1. The LocoMe administrator will not be accountable for periodic and temporary breaks in service’s operations, stemming from technical modifications and action aimed at improving the application. The users will be notified of the scheduled breaks in operations in an advance (if possible).
  2. The administrator will not be accountable for disturbances and breaks in service’s operations stemming from malfunctions, unlawful or unskilful user action or Force Majeure. The administrator will not be accountable for any losses stemming from the above.
  3. The user is fully responsible for any transferred and published content, images, data and other information, as well as for its form. LocoZone Sp. z o.o will not be accountable for aforementioned content, points of view and opinions published by the users on the LocoMe service. The administrator will monitor the service and has the right to modify and/or delete the unlawful content (including content breaking the rules set hereby, as well as moral, ethical and social norms).
  4. The administrator will not be responsible for actions of LocoMe users or other persons using the service in an illegal way, as well as for any losses caused by such use (especially using the personal or location data, images, content or other information published on the service in an illegal way, in a way which breaks the rules set herein, the moral, ethical and social norms, or in a way which violates other persons’ dignity). The person responsible is the person who has committed such actions.
  5. The user may use the links to other services and websites published on LocoMe, but he/she does so on his/her own responsibility and risk. LocoZone Sp. z o.o. is not responsible for the content, information, materials or services offered on the sites connected to the links.
  1. Complaints and guarantees
  1. Any problems and observations regarding LocoMe operations, or the services it provides, can be directed to the administrator (see: Contact).
  2. LocoZone Sp. z o.o. reserves the right to leave a complaint unresolved, if it stems from the lack of familiarity with the rules set hereby or the rules of law. In other cases the administrator will resolve the complaint within 14 days from its filing.
  3. All user complaints regarding the services offered by any third party through the LocoMe service will not be taken into account. It is not administrator’s duty to forward such complaints to the entity responsible for their resolution.
  4. The administrator takes great care in assuring the best quality of the services provided, however he cannot guarantee the service to be completely reliable. All flaws will be taken care of instantly and in full. LocoZone Sp. z o.o. cannot guarantee full compatibility with the user’s mobile phone.
  5. The administrator has the right to look into a user account in order to remove any problems and/or flaws in the account or the whole service.

  2. The rules and terms of use are valid from the day of their publication on the LocoMe website
  3. The cancellation or modification of any of the rules herein does not cancel other provisions set herein.
